Refund policy

In short

You have 30 days from delivery to change your mind: a 14-day statutory right of withdrawal, followed by our money-back guarantee up to day 30.
For hygiene reasons, the device must reach us in its original sealed packaging, unopened and undamaged.
You pay the cost of returning the product; our returns centre is located in China.
If a product is faulty or damaged, we will replace it at no cost to you whatsoever.

Who is the seller?

1. Your statutory right of withdrawal (14 days)

You have the right to withdraw from the contract within 14 days without giving any reason. The withdrawal period expires 14 days from the day on which you, or a third party other than the carrier indicated by you, takes physical possession of the goods. If your order consists of several products delivered separately, the period runs from the day you receive the last product. If the last day of the period falls on a Saturday, Sunday or public holiday, the period expires on the next working day. You may also exercise your right of withdrawal in the period between the conclusion of the contract and the day you receive the goods.

Send us an unequivocal statement of your intention to withdraw before the period expires, by email to contact@medwellprotect.com or by post to the address above. You may use the model form at the bottom of this page, but you are not obliged to. Returning the parcel or refusing delivery without notifying us is not sufficient.

2. Money-back guarantee up to day 30

In addition to this statutory right, we voluntarily offer a money-back guarantee: if you are not satisfied with the product, you may return it to us up to the 30th day after you receive it and we will refund the amount you paid, on the same conditions as withdrawal (the device's sealed packaging must be intact, you pay the return cost, and the procedure in section 4 applies). To use the guarantee, notify us by email no later than day 30.

Cost: free. Duration: 30 days from delivery. Territorial scope: every country we ship to.

This guarantee does not affect your statutory rights in respect of goods that do not conform to the contract, including any rights against us or against the producer under applicable law.

3. Sealed device: cannot be returned once opened

The Medwell anti-choking device (pump and masks) is shipped in sealed packaging. It is designed to be placed on the face and mouth. For health protection and hygiene reasons, you therefore cannot return it on the grounds that you have changed your mind if you have unsealed it after delivery. This reflects the exception for sealed goods that are not suitable for return for health protection or hygiene reasons under applicable consumer protection law. As long as the seal is intact, the right of withdrawal and the money-back guarantee apply as normal.

Other products, such as the Emergency Blanket, can be returned even if unpacked. You are liable for any diminished value of the goods only where that results from handling beyond what is necessary to establish their nature, characteristics and functioning.

This exception never applies to a faulty or damaged product: see section 6.

4. How to return a product

Email us at contact@medwellprotect.com with your order number and the products concerned.
Once we accept your request, we will give you the address of our logistics returns centre, located outside the European Union in China, and tell you what to do.
Pack the product carefully and send it back no later than 14 days after you receive that address. We recommend a tracked service; keep your proof of postage.

Do not send anything before you have received the return address: a parcel sent elsewhere may never reach us.

You bear the direct cost of returning the product. This is an international shipment to China: the cost depends on the carrier and service you choose.

5. Refunds

Withdrawal (14 days): we will refund the full amount you paid, including any delivery charge, without undue delay and no later than 14 days from the day we are informed of your withdrawal. We may withhold the refund until we have received the goods back, or until you have supplied evidence of having sent them back, whichever is the earlier.

Money-back guarantee (day 15 to day 30): once the product has arrived and been checked, we will refund the full amount you paid, including any delivery charge, no later than 14 days after it arrives.

In both cases we refund using the payment method you used for the order, at no additional cost to you. The cost of return remains yours. If the device's sealed packaging was opened after delivery and the reason for return is that you changed your mind, we will not refund its price; we will tell you by email.

6. Faulty, damaged or non-conforming products

Email us at contact@medwellprotect.com with your order number and photographs of the product and its packaging.

We will first offer to replace the product. You may however still choose between repair and replacement. Repair or replacement is entirely free for you (we pay to send the replacement and to return the faulty item if needed), and we aim to complete it within 15 days. The packaging does not need to be sealed.

You may bring a claim against us for lack of conformity for 2 years from delivery; where a repair is carried out, that period is extended once by 12 months. You may also have a claim against the producer or distributor of the product. Notify us of the defect promptly after discovering it, and no later than two months afterwards. The details are set out in the highlighted part of article 8 of our terms of service.

7. Refused or uncollected parcels

Refusing delivery of a parcel, or failing to collect it, does not count as withdrawal. The carrier will return the parcel to us. Once it is back in our warehouse we will contact you, and you may choose: either we send it to you again, with the cost of re-dispatch payable by you, or we refund the amount you paid for the order.
